Michigan: Homeowner: Illegal entry was more than that
Flint Journal

"A Saginaw Township man says police let him down when they refused to arrest an 18-year-old man who broke into his house by smashing a sun room window after midnight Thursday. Jerry Persons, 65, who had open heart surgery in May, said a state police detective told him the intruder wasn't arrested because he needed 60 stitches and officers couldn't wait at the hospital. .... Police were chasing four teens who were apparently drinking underage in a nearby apartment complex. One thought he was ducking onto an open porch and never saw the quarter-inch plate glass, Persons said. Person jumped out of bed at the sound of crashing glass. He saw the invader crouched behind a chair in his 350-square-foot solarium and trained his .22-caliber revolver on him.
Then several officers from Saginaw County's Safe Streets squad with flashlights appeared in his back yard. "They says drop your gun. I says, 'No way,' because I had my gun trained on this individual," Persons said.
He said he eventually lowered his weapon as police aided the teen." (07/22/05)

Roberts dissents from gun search ruling
Boston.com

"Supreme Court nominee John Roberts sided with police but was on the losing end of an appeals court decision on whether officers were within their authority to search the trunk of a suspect's car. Roberts dissented in a 2-1 ruling from the U.S. Court of Appeals for the District of Columbia, reversing a man's conviction for unlawful possession of a firearm. The decision was released by the court Friday, even as Roberts was touring Senate in a political candidate-like search for confirmation votes.Roberts said in his minority opinion that U.S. Park Police were justified in searching the trunk of a car and seizing a .25-caliber pistol found there after the officers performed a records check and discovered the vehicle's temporary license tags were stolen in Fairfax County, Va." COMMENTARY

The Second Amendment is alive and well
JPFO
staff

"A right remains a right, no matter what any government says
or does. Rights are G-d-given.* Rights are inborn. It is certainly true that governments ride rough-shod over rights. But to say that right is dead because a government abuses it is rather like saying that the sky is red with purple polka-dots just because some legislature says so.Many people mistake the Bill of Rights for a contract. Contracts can be altered at will by the parties involved. The Bill of Rights is NOT a contract. It is an acknowledgment of pre-existing conditions. .... So read Mr. Brownlow's article and consider its arguments. But never despair. The Second Amendment is alive and well and will remain so as long as armed Americans possess the will to defend their own homes, neighborhoods, and families against some future tyranny." (07/22/05)
